Gorman v. Ratliff
Arkansas Supreme Court
712 S.W.2d 888 (1986)
- Written by Sean Carroll, JD
Facts
Johnny and Mary Gorman (plaintiffs) rented property from Russell Ratliff (defendant). The lease stated that if the Gormans failed to pay rent, Ratliff was permitted to enter the premises and take and store all property therein. The Gormans became late on their rent. Ratliff entered the premises while the Gormans were out and took all of their personal property. Ratliff stored the property pursuant to the provision in the lease. The Gormans sued Ratliff on a number of grounds. The trial court found in favor of Ratliff based on the self-help provision in the lease. The Gormans appealed.
