May 29, 2007, Kareem Grant (defendant) contracted to buy a house from Jeffrey
Ganz, contingent on Grant obtaining a loan to finance the purchase. On July 20,
2007, the Kahns (plaintiffs) obtained a money judgment against Ganz. On July
31, 2007, Grant and Ganz closed on the sale of the house. Subsequently, the
Kahns filed a petition for a writ of execution on the house. Grant filed a
motion to release the house from the lien, arguing the doctrine of equitable
conversion applied. The circuit court ruled in favor of the Kahns, finding that
the doctrine of equitable conversion was inapplicable due to the financing
contingency. Grant appealed.
