Facts

On January 26, 1978, Gary Donroe (defendant), while in a state of emotional distress, shot himself in the shoulder. Donroe then contacted the police and told them he had been robbed by a black man wearing a blue hat and a green jacket. Coincidentally, John Green (plaintiff) matched Donroe’s description, so the police detained him. Green was detained for about ten minutes before Donroe failed to identify him as the robber and Green was released by the police. Donroe later admitted to the police that he shot himself. As a result of his brief detainment, Green brought suit for damages for false imprisonment. After losing at the trial level, Green appealed.
