Facts
Heather Haley (plaintiff) was being considered for a promotion, and her employer obtained a consumer report or background check from TalentWise, Inc. (defendant). The report listed a dismissed robbery charge that was more than seven years old and included two references to a charge of refusing to submit to a breathalyzer; one reference reflected the charge as having been dismissed, and the other showed that the charge resulted in a conviction, which was incorrect. Haley was fired after her employer received the report, and she requested a copy of the report from TalentWise. The report Haley received omitted the dismissed robbery charge but included the two conflicting references to the breathalyzer charges. Haley sued TalentWise under the Fair Credit Reporting Act (FCRA), which regulated consumer reporting agencies that provided consumer reports to employers. TalentWise moved to dismiss Haley’s complaint.
