Facts

A group of employees (defendants) of Harris Group, Inc. (plaintiff) decided to leave their jobs and establish a new company to compete with Harris Group. Before leaving their jobs, the employees copied Harris Group’s files and deleted information. Upon leaving their jobs, the employees sent form letters to Harris Group’s customers that the customers could use to terminate their contracts with Harris Group and transfer their business to the new company. The customers’ contracts with Harris Group were terminable at will. Harris Group sued the employees and their new company for tortious interference with contract. The jury found that the employees and their new business had fraudulently and maliciously committed conversion and breach of fiduciary duty in interfering with Harris Group’s customer contracts. Harris Group was awarded roughly $1.9 million in compensatory damages and roughly $630,000 in punitive damages. The employees appealed.
