Brenda Joy Harrison (plaintiff) filed a two-count complaint against Marvin Pritchett (defendant) to recover damages relating to Harrison’s provision of various household and personal services to Pritchett and his family between 1976 and 1994. In the first count for breach of an oral contract, Harrison alleged that in 1984, Pritchett orally agreed to establish a trust fund of $250,000 for Harrison, in exchange for which she would perform services until 1994. Harrison performed the services, but Pritchett failed to establish or maintain the trust fund. In the second count for recovery in quantum meruit, Harrison alleged that she provided services between 1976 and 1994 for the benefit of the Pritchett family with the expectation of being paid for the reasonable value of her services or $250,000, and that Pritchett failed to pay Harrison. The trial court granted Pritchett’s motion for judgment on the pleadings as to both counts based solely on applying the statute of frauds. The relevant statute of frauds required contracts that could not be fully performed within one year to be in writing. Harrison appealed.
