Hera Shipping, Inc. (Hera) (plaintiff) was an international courier that imported merchandise into the United States. The district director of customs in Miami, Florida (government) (defendant) issued a notice to Hera that Hera would be required to increase the value of its customs bond from $50,000 to $1,300,000 because the previous bond amount was insufficient in view of Hera’s potential liabilities. Specifically, the government stated that there was evidence that Hera was regularly importing liquor into the United States without filing entries or paying associated duties or taxes. Hera sued the government alleging violations of its due-process rights because the government did not hold a hearing prior to increasing the bond amount. The government moved for summary judgment, arguing that it had the authority to increase bond amounts without holding a prior hearing.
