Facts
Ron Hicks (plaintiff) lost his wife and daughter when a cattle truck collided with a school bus on a narrow bridge near Fort Summer, New Mexico. The bridge had been constructed and maintained by the New Mexico State Highway Department (highway department) (defendant). Hicks sued the highway department for negligence. The highway department filed a motion to dismiss, arguing that it could not be sued, because it had sovereign immunity. The district court granted the motion. Hicks appealed.
