House v. Combined Ins. Co. of America

Jody House (plaintiff) worked for Combined Insurance Company of America (Combined) (defendant). House sued, alleging her supervisor, Bola Olarundami (defendant), sexually harassed her. Before trial, Combined designated Dr. Michael Taylor, a psychiatrist, as an expert expected to testify. Taylor examined House, and House took notice of his deposition and sought to compel production of his examination report. Combined said it would not call Taylor to testify and moved to quash his deposition. Combined sought a protective order barring discovery related to Taylor. Though Combined did not officially withdraw its designation of Taylor as an expert, it did remove him from its witness list. The magistrate judge ruled that House was entitled to see Taylor’s report but not depose him. The United States District Court for the Northern District of Iowa orally ruled that House could depose Taylor, but reserved for its written opinion a final ruling on the motion in limine related to whether House could offer Taylor’s testimony at trial.
