Facts
Individuals who took the prescription drug Abilify (consumers) (plaintiffs) brought suit against Bristol-Myers Squibb Company and Otsuka America Pharmaceutical Inc. (companies) (defendants). The consumers filed a motion to compel the production of certain documents listed on the companies’ privilege logs. The consumers raised three challenges to the companies’ withholding of the documents: first, that the descriptions contained in the privilege logs were inadequate; second, that documents withheld on the basis of work-product protection did not qualify as work product; and third, that documents withheld on the basis of attorney-client privilege were not privileged. The companies filed an opposition to the motion and submitted all the documents on their privilege logs for in camera review.
