Facts
The city of New York (plaintiff) used the power of eminent domain to condemn several properties in the Lincoln Square area. A court set the condemnation values for the properties. One year before the condemnation-value proceeding, the owner of one parcel had tried to have the parcel’s property-tax bill reduced by claiming to the tax authorities that the parcel was worth only $1.1 million. The court found that the owner’s prior statement about the parcel’s value was admissible evidence. However, the court did not give the owner’s statement much weight. Relying heavily on other evidence, the court determined that just compensation for the parcel was approximately $2.4 million.
