Facts
Ricky Green was 16 years old and had paralytic scoliosis, rendering him unable to stand or walk. A surgery was recommended to fix Ricky’s condition, which would become worse absent surgery. Ricky’s mother (defendant) would not consent to the use of a blood transfusion during the surgery. The mother was a Jehovah’s Witness, and the use of blood transfusions was contrary to her religious beliefs. The state (plaintiff) filed a petition alleging neglect of Ricky asking the court to appoint a guardian who would consent to the surgery unconditionally. The trial court dismissed the petition. The superior court reversed. The Supreme Court of Pennsylvania granted review.
