Facts

The Los Angeles County Department of Children and Family Services (department) (plaintiff) initiated a dependency proceeding against IJ (father) (defendant), the father of two girls, ages 14 and nine, and three boys, 12-year-old twins and an eight-year-old. The department accused the father of having sexually abused and raped his older daughter over a three-year period beginning when she was 11 years old. There was no evidence that the father had abused any of his other children, and the boys testified that they liked and felt safe with their father. The juvenile court sustained the department’s allegations, declared all five children dependents of the court, and placed the children in their mother’s custody. The court’s action initiated a multistage process that could lead to termination of the father’s parental rights. After an intermediate appellate court affirmed the juvenile court’s ruling, the father appealed to the California Supreme Court.
