Twelve-year-old M.D. (defendant) was charged with complicity to commit rape based on her conduct with two five-year-old children that was characterized by the families of the children involved as “playing doctor.” M.D. filed a motion to dismiss the petition in the juvenile court, arguing that her prosecution for a felony sex crime was contrary to the law and violated juvenile court intake policy, thereby implicating her constitutional rights. The family of one of the five-year-old children involved in the incident also petitioned the juvenile court to dismiss the case. The juvenile court rejected both efforts to dismiss the case, and M.D. was subsequently adjudicated delinquent. M.D. then appealed the juvenile-court judgment. The appellate court affirmed the judgment of the juvenile court, and M.D. again appealed.
