Facts
Robert Horn (defendant) and Cyndee Horn were married in 1974 and separated in 1983. Robert played professional football from 1976 to 1984. In 1982, the National Football League (NFL) adopted a provision for severance pay, entitling players to a lump sum based on the amount of time they spent in the NFL. Robert was entitled to $100,000 under the provision. Cyndee sought an entitlement to the severance pay, and the trial court awarded Cyndee a community interest in the pay. Robert appealed.
