Jackson v. Commonwealth

Kentucky Court of Appeals
18 Ky. L. Rptr. 795 (1896)

KL

Facts

Scott Jackson (defendant) was convicted of the murder of Pearl Bryan. Bryan’s decapitated body was found in a farm in Kentucky. Her head was never found, but there was a significant amount of blood near her body, leading police to believe she was killed in Kentucky. She was pregnant at the time of her murder, and evidence at trial confirmed that Jackson had suggested several abortion methods to her. Prior to her death in Kentucky, Bryan traveled to Ohio to see Jackson. While in Ohio, Bryan nearly died of a cocaine overdose, and Jackson provided the drugs to her, purportedly to induce an abortion. Jackson then traveled with Bryan in a cab back to Kentucky from Cincinnati on a Friday, and she was found dead on Saturday. Jackson appealed his conviction, claiming that it was not clear where Bryan died and that Kentucky did not have jurisdiction over any conduct committed in Ohio.
