Facts

Jennings (plaintiff) was a female student and soccer player at the University of North Carolina (UNC) (defendant). The coach of the UNC women’s soccer team, Coach Dorrance, repeatedly asked players about their sexual partners and activity during team practices and showed inappropriate physical affection to at least one player. Jennings was the target of Coach Dorrance’s sexual questioning on more than one occasion. This made Jennings uncomfortable. Jennings complained to the UNC legal counsel, who replied that Jennings should try to work it out with Coach Dorrance. No further action was taken by UNC. Jennings filed a lawsuit against UNC alleging that UNC discriminated against her in violation of Title IX by allowing Coach Dorrance to create a hostile environment within the women’s soccer program by subjecting players to sexual harassment. The trial court granted summary judgment in favor of UNC, and Jennings appealed.
