Mrs. Ready (plaintiff) worked for Joe Ready’s Shell Station & Cafe (the Shell station) (defendant). Mrs. Ready performed various duties at the Shell station during the day, and in the evening she did bookkeeping work for the Shell station at home. When Mrs. Ready did her bookkeeping, she sat on her couch and used a table pulled up to the couch. One evening, Mrs. Ready had completed her household tasks for the night and was about to sit down on the couch to do her bookkeeping work when she noticed a gun on the couch. The gun belonged to Mrs. Ready’s husband. Mrs. Ready’s husband had lent the gun to another person, that person had brought the gun to the Shell station, and a Shell station employee who lived nearby had brought the gun to the Readys’ home, leaving it on the couch. When Mrs. Ready moved the gun so she could sit down to work, the gun accidentally discharged and injured Mrs. Ready. Mrs. Ready filed a claim for workers’-compensation benefits. The Workmen’s Compensation Commission awarded Mrs. Ready benefits, and the circuit court affirmed the order. The Shell station appealed.
