Facts
The New York Education Department’s Office of Professional Discipline (OPD) (defendant) conducted a disciplinary hearing on misconduct charges brought against a dentist. Johnson Newspaper Corporation (plaintiff) sought access to the disciplinary hearing. OPD denied the request on the ground that it was the policy of the Board of Regents, the final decision-maker in disciplinary proceedings, to conduct closed professional disciplinary hearings unless the accused affirmatively requested an open hearing. Johnson brought a proceeding to obtain public access to the disciplinary hearing. The trial court dismissed the proceeding. The Appellate Division affirmed. Johnson appealed.
