Facts
The Food and Drug Administration (FDA) (defendant) approved the drug mifepristone, the abortion pill. Judicial Watch, Inc. (plaintiff) submitted a Freedom of Information Act (FOIA) request asking for all documents related to mifepristone. When the FDA failed to produce those documents, Judicial Watch sued in federal district court. The district court ordered production of the documents. The FDA handed over 9,000 pages but withheld all or part of 6,000 documents pursuant to various FOIA exemptions. The agency also produced a 1,500-page Vaughn index to explain the reasons for withholding certain documents. Judicial Watch claimed that the withheld documents were not adequately explained. The FDA moved for summary judgment, which the district court granted. Judicial Watch appealed to the District of Columbia Circuit.
