K.K. Coral Corp. v. Marine Bio K.K.
Tokyo District Court
Heisei 02 (Wa) 1943 (2003)

- Written by Rich Walter, JD
Facts
The Japanese companies K.K. Coral Corporation (Coral) (plaintiff) and Marine Bio K.K. (defendant) manufactured similar coral-based health products. Marine Bio marketed its product in the United States (US). After Coral began selling its competing product in the US market, Marine Bio licensed a relevant existing US patent and threatened Coral’s US distributor with a US lawsuit for infringing that patent. Marine Bio’s conduct effectively drove away some of Coral’s US customers and arguably violated Japan’s unfair-competition statute. Coral sued Marine Bio in Tokyo District Court, seeking orders barring Marine Bio from (1) enjoining sales of Coral’s product in the US and (2) disseminating, from Japan, notices to Coral’s US customers that Coral’s product infringed Marine Bio’s US patent.
