Facts

In 2021, the Texas legislature passed a bill amending the Texas Election Code. Among other things, the bill amended the regulatory structure relating to voting, poll watchers, and other volunteers. The bill gave poll watchers additional rights. La Union del Pueblo Entero (plaintiff) sued the State of Texas (defendant), alleging the bill was unconstitutional. The Republican National Committee and other national and local Republican committees (the committees) moved to intervene in the case. The committees expended significant resources related to educating, assisting, and training poll watchers and other volunteers in Texas and wished to see the bill upheld. It was undisputed that the committees’ motion was timely. Separately, the state asked that the case be dismissed based on sovereign immunity. The district court denied the committees’ motion. The committees appealed.
