Facts

In 1966, Jacques and Therese Lalonde (plaintiff) purchased property in a development along Lake Champlain. According to a recorded map of the property, which is referred to in the deed, one of the lots purchased was to be used only as a park. In 1982, Renaud (defendant) purchased a portion of this land from Lalonde. The portion purchased included the lot that was to be used solely as a park. When Renaud attempted to develop the land on which the park sat, Lalonde brought suit to prevent said development. The trial court ruled in favor of Lalonde, stating that Lalonde sold his property with reference to the map that indicated the placement of the park, prohibiting Renaud from developing that land. Renaud petitioned for certiorari to the Supreme Court of Vermont.
