Christopher Debord assaulted Gregory Langadinos (plaintiff) while both men were passengers on an American Airlines, Inc. (American) (defendant) flight. Langadinos sued American in the United States District Court for the District of Massachusetts, alleging that American's flight attendants played a causal role in the assault, thereby violating an international treaty on air passenger rights. The complaint recited Langadinos's "information and belief" that, prior to the assault, American's flight attendants continued serving Debord alcohol despite being aware of Debord's intoxication and his aggressive behavior toward Langadinos. American responded that the complaint failed to describe how the flight attendants would have acquired that awareness, and was based only on Langadinos' information and belief rather than on his personal knowledge that the flight attendants had that awareness. The court accepted American's argument and dismissed the complaint pursuant to Federal Rule of Civil Procedure 12(b)(6). Langadinos appealed to the United States Court of Appeals for the First Circuit.
