Lanni v. New Jersey

United States Court of Appeals for the Third Circuit
259 F.3d 146 (2001)

Facts

Phillip Lanni (plaintiff) was an employee at the New Jersey Department of Environmental Protection (department) (defendant). Lanni had a number of learning disabilities, and the department mistreated Lanni because of his disabilities. Lanni filed suit, contending that the department violated the Americans with Disabilities Act (ADA). Lanni was represented by attorneys Linda Wong and Daniel Fleming. The district court entered judgment in favor of Lanni. Subsequently, Lanni filed a motion for attorneys’ fees, seeking over $1.1 million in fees. The district court calculated the reasonable hourly rates for Wong and Fleming on a graduated scale, varying according to the time period during which the services were performed. The district court ultimately awarded Lanni $277,723.50 in attorneys’ fees. Lanni appealed, arguing that the district court erred in its calculation of attorneys’ fees.
