Facts
Helen Latimore (plaintiff), a Black woman, submitted an application for a mortgage loan to Citibank, F.S.B. (Citibank) (defendant). Latimore used her home as collateral for the loan. Ed Kernbauer, an in-house appraiser at Citibank, prepared an appraisal of Latimore’s home. Because the appraisal value of Latimore’s home was not high enough to support the loan, Citibank denied Latimore’s loan application. Latimore brought suit against Citibank, contending that Kernbauer’s appraisal methods differed depending upon the race of the homeowner, thereby violating the Fair Housing Act (FHA). However, the evidence indicated that Kernbauer’s appraisal of Latimore’s home was based on the same method that Kernbauer used to appraise similarly situated homes owned by White people. Citibank filed a motion for summary judgment. The district court took the motion under advisement.
