Facts
Lira (plaintiff) brought a medical malpractice suit against Albert Einstein Medical Center (hospital) (defendant), claiming that she was injured when one of the hospital’s doctors inserted a tube in her throat. Lira sought to introduce evidence that when her throat was examined by a third party throat specialist, he said “Who’s the butcher who do [sic] this?” The trial court allowed the evidence, but then awarded a new trial when it determined that its evidentiary ruling was incorrect. Lira appealed.
