Facts
Harald Martinson (plaintiff) worked as a shoe salesman for Kinney Shoe Corporation (Kinney) (defendant). In addition to selling shoes, Kinney salespeople were tasked with maintaining store security. Often, two or three salespeople worked at the store at the same time, but on some occasions, Martinson worked alone. Martinson had epilepsy, resulting in seizures that caused him to collapse and rendered him unconscious for several minutes at a time. Kinney fired Martinson after he had several seizures at work. The Equal Employment Opportunity Commission (EEOC) (plaintiff) sued Kinney on Martinson’s behalf, alleging discriminatory firing in violation of the Americans with Disabilities Act (ADA), and Martinson intervened in the lawsuit. The district court granted summary judgment in favor of Kinney, and Martinson and the EEOC appealed.
