Facts
The respondent wife (plaintiff) was a Guatemalan citizen living in Guatemala. The wife’s husband repeatedly abused her, but the local police stated they would not interfere in a spousal dispute. The wife attempted to leave multiple times but the husband found her each time and threatened to kill her if she left again. The wife fled to the United States (defendant) and applied for asylum and withholding of removal under the Immigration and Nationality Act (INA). The immigration judge denied the applications. The wife appealed.
