Facts
John McCown (plaintiff) was driving a tractor manufactured by International Harvester Company (IHC). The tractor hit a guardrail, causing the steering wheel to spin quickly and injure McCown. McCown brought a products-liability suit based on §§402A of the Second Restatement of Torts (section 402A). IHC admitted the defectiveness of the steering wheel’s design. The jury found in favor of McCown. IHC appealed, arguing that McCown’s contributory negligence in hitting the guardrail should be considered in determining McCown’s recovery.
