Facts
Gary Miller (plaintiff) was injured when he fell from his truck due to a stray bullet from a nearby target practice ricocheting toward him. Miller brought suit against the owner of the firing range and the employer of the police officers engaged in the target practice (defendants) on a theory of strict liability. The trial court dismissed the strict liability claims. Miller appealed.
