Facts
Two owners (plaintiffs) of National Football League (NFL) (defendant) teams gained ownership interests in North American Soccer League (NASL) (plaintiff) teams. The NFL had a long-standing, unwritten policy against any of its owners or their immediate family members from owning an interest in a team in another league. The football team owners and the NASL brought suit against the NFL challenging its ban against cross-ownership as violating § 1 of the Sherman Act. The district court upheld the NFL’s cross-ownership ban and the NASL appealed.
