Facts

In a previous case, Edward Tuccio (defendant) sued Harry Neumann (plaintiff) for slander. Neumann alleged that Tuccio knew before he proceeded with the lawsuit that the allegations of slander in the complaint were unfounded. The case went to trial and the court granted a directed verdict in Neumann’s favor because Tuccio had failed to establish a prima facie case. Neumann then brought the current case for vexatious litigation against Tuccio. Tuccio raised the defense of advice of counsel. Neumann filed a motion to disqualify Tuccio’s attorney John Williams, on the grounds that Williams would be a necessary witness to the action.
