Facts

During an investigation into illegal sports gambling, a wiretapping operation overheard conversations involving Merrell Hunt (defendant). An informant later told investigators that Hunt was running a gambling business over the phone. A detective went to a telephone company’s office and obtained the home toll billing records for Hunt’s phone numbers for a two-month period. The detective did not obtain a warrant for the records. The records indicated that Hunt regularly called a sports service that provided timely results of sporting events. Thereafter, Hunt and a codefendant were indicted for various gambling-related crimes. Hunt was convicted and received a brief jail sentence. Hunt appealed on various grounds, but the intermediate appellate court affirmed. Hunt again appealed, arguing that the warrantless search and seizure of the toll billing records violated his rights.
