Facts
John Cole and Tara Cole (defendants) intentionally caused injury to John’s son, 16-year-old Clinton Cole, resulting in Clinton’s death. Anna Belle Newman (plaintiff), the personal representative of Clinton’s estate, brought a wrongful-death action against the Coles. Newman asserted claims of negligent, wanton, and willful and intentional conduct. The Coles moved to dismiss the complaint based on the parental immunity doctrine. The trial court granted the motion. Newman appealed, arguing that the court should abolish or modify the doctrine.
