Facts
Angela Ochoa (plaintiff) was injured when Paul Gulley hit Ochoa’s car while he was driving a Budget rental car. Ochoa was a citizen of Louisiana. Ochoa sued Paul Gulley, Budget Rent A Car System, Inc., and PV Holding Corporation (defendants). The defendants removed the lawsuit to federal district court based on diversity jurisdiction. Ochoa made a motion to remand the case, arguing that the federal court did not have subject matter jurisdiction. The federal court agreed that it did not have subject matter jurisdiction and remanded the suit back to the Civil District Court for the Parish of Orleans.
