Orthokinetics (plaintiff) sued Safety Travel Chairs (STC) (defendant) for infringing the ‘867 patent claiming a wheelchair for children that permitted the easy transition to and from an automobile seat. STC began to sell a similar chair several years after the ‘867 patent issued, which predicated the suit. STC alleged that the patent was invalid under 35 U.S.C. §112, ¶2 for failing to point out and distinctly claim the invention. However, the jury disagreed and held the patent valid and infringed. After the verdict, STC moved for a judgment notwithstanding the verdict (JNOV), which was granted by the district court. Orthokinetics appealed.
