Facts
Keefer (defendant) encouraged Chapman to tie Lee Yuen. Thereafter, unbeknownst to Keefer, Chapman killed Yuen. Keefer was charged with murder. At trial, Keefer’s counsel asked the court to instruct the jury that Keefer could not be found guilty of murder if Keefer was not present when Yuen was killed and did not aid or abet Chapman in killing Yuen nor had conspired with Chapman to kill Yuen. The court refused the instruction and Keefer was found guilty of murder and he appealed.
