Facts
The State of Illinois (plaintiff) prosecuted Noah D. Rife (defendant) for receiving stolen goods. Trial evidence showed that Henry Brandon stole a large quantity of used brass from a railroad company. Brandon sold the brass to Rife, who stored the brass in his junkyard, where a company employee and a deputy sheriff found it. Rife had recently and repeatedly been warned to be alert for stolen railroad brass and to notify the sheriff's office of any suspicious activity. Rife testified that the possession of so much brass in Brandon’s hands did not arouse his suspicions, and that Brandon assured him that the brass was not stolen. However, Rife's wife testified that she told Rife that Brandon stole the brass. The jury convicted Rife, who appealed to the Illinois Supreme Court.
