Facts

Anthony Pezza was married to Olga Pezza (plaintiff). Anthony had two children from a former marriage, Patricia and Michael (defendant). Anthony created an inter vivos trust, designating himself as trustee and Michael as successor trustee. Four parcels of land were conveyed to the trust for the benefit of Patricia and Michael. A few years later, Anthony resigned as trustee, appointed Michael as his successor trustee, and waived his right to revoke the trust. A few months later, Anthony also disclaimed his power to demand payment of the trust principal. When Anthony died, Olga brought suit, claiming that Anthony’s transfer of property into the trust was fraudulent and that she should have a life estate in the property. The trial court found that the trust was valid, and Olga appealed.
