Facts

Slep-Tone Entertainment Corporation (plaintiff) made karaoke tapes and CDs with prerecorded music and corresponding lyrics and graphics. Slep-Tone’s trademark and trade dress appeared in the graphics. Rumsey (defendant), a pub owner, made unauthorized copies of Slep-Tone music and graphic files and played them at the pub. Slep-Tone sued Rumsey for violating the Lanham Act by passing off the unauthorized copies as genuine Slep-Tone products. The district court dismissed Slep-Tone’s complaint. Slep-Tone appealed.
