Facts
Pierce (plaintiff) had a Citibank (South Dakota) (defendant) credit card. Pierce’s husband became delinquent in his credit card accounts, and Citibank closed his accounts. In its notification to Pierce’s husband, Citibank included the number of Pierce’s credit card account but not her name. Pierce continued to receive regular statements until she learned her credit account was closed when she talked to a Citibank representative. The representative said Pierce could not use her card until her husband’s account was resolved. Pierce sent Citibank a written letter demanding to know why her account had not been renewed. Citibank replied by sending her a letter stating that her account had been reactivated. Pierce sued, arguing that Pierce had never received the required written notice under the Equal Credit Opportunity Act. Pierce moved for partial summary judgment.
