Facts
Eloise Holmes (defendant) rented an apartment from J.C. Pugh (plaintiff) from November 1971 to August 1976. Pugh brought an action to evict Holmes for not paying her rent from September 1975 to August 1976. The trial court ruled in favor of Pugh. Holmes appealed, with the appellate court ruling in her favor, and striking down the doctrine of caveat emptor in real estate leases. Pugh petitioned for certiorari to the Supreme Court of Pennsylvania.
