Facts
David Warman (defendant) worked for Quality Systems, Inc. (QSI) (plaintiff), a supplier of computer talent to contractors. Warman supervised six other managers who were colloquially known as the friends of Dave. Warman resigned and went to work for a competitor, Windermere, and during the next six weeks, all the friends of Dave and 31 nonmanagerial employees left QSI to go to work for Windermere. QSI sued Warman for breach of the duty of loyalty. Deposition testimony from some of the nonmanagerial employees reflected that neither Warman nor any of the friends of Dave discussed Windermere with them while Warman and the friends of Dave were still employed at QSI. The nonmanagerial employees also testified that their decisions to leave QSI were unrelated to the conduct of Warman and his circle of managers. Warman moved for summary judgment.
