Facts
The Fairbanks North Star Borough School District (the district) (defendant) refused to hire Nada Raad (plaintiff) for a full-time teaching position at Ryan Middle School, claiming that Raad’s accent would impair her effectiveness as a teacher. The district instead awarded the position to a less-qualified candidate. During the two previous hiring cycles, the district also refused to hire Raad for a full-time position. Raad, a woman of Lebanese descent, had excellent undergraduate and graduate school records, strong recommendations from her graduate-school instructors, and had worked as a substitute teacher for the district for several years. Other teachers frequently requested Raad as their substitute, and Raad had received positive performance reviews. Raad sued the district, alleging that it had discriminated against her because of her national origin in violation of Title VII of the Civil Rights Act of 1964 (Title VII). Raad alleged, among other things, that the district had undervalued her grade point average (GPA) and writing sample to exclude her from the hiring pool for full-time positions and that a district employee had falsified records to indicate that the district had conducted competitive interviews for certain teaching positions when it had not. The district court granted summary judgment in favor of the district, and Raad appealed.
