Facts

German national Muller Werner and his wife divorced. Mrs. Werner obtained custody of their child, Maria Luisa, in an Italian court, while Mr. Werner received custody of the child in a German court. Maria Luisa, who had dual nationality, lived with her mother in Genoa, Italy. Mrs. Werner advised the German consul general in Genoa, Dr. Rissmann (defendant), and local authorities that she disapproved of Maria Luisa receiving a German passport. Nonetheless, Rissmann issued a passport in Maria Luisa’s name and assisted Mr. Werner with travel arrangements to transport Maria Luisa to Germany. Rissmann was charged with violation of Italian law. Rissmann moved to dismiss based on consular immunity.
