The water system in Parsippany-Troy Hills Township (the township) (defendant) was owned and operated by the township. Reid Development Corporation (Reid) (plaintiff) owned property that it was developing into residential lots. Reid requested that the township extend its water system so as to provide water for Reid’s property. The township had broad discretion in determining the costs a property owner would incur for an extension. The township stated that it would reduce the costs that Reid would incur for the extension if Reid developed lots with 100 feet of frontage. Reid rejected the condition and brought suit, contending that the township abused its discretion by imposing the condition. The trial court found that there was no abuse of discretion. Reid appealed.
