Facts
A group of individuals (defendants) received taxable distributions from a partnership. The individuals hired various professionals to help the individuals calculate their generation-skipping transfer (GST) tax liability on the distributions. The individuals deducted on their income taxes a portion of the expenses incurred by hiring the professionals. The individuals did not file with their income tax returns a statement saying that they would not claim the expenses as deductions against the GST tax. The individuals then filed GST tax returns that sought to deduct from their GST tax liability all of the expenses incurred by hiring the professionals. The United States (plaintiff) brought suit to deny the GST tax deductions.
