Facts
Terry Bunn, Jr. (defendant) met Megan Rondini, a college student, for drinks, after which they went back to Bunn’s residence. Megan sent text messages to her friends indicating an intention to engage in sexual relations with Bunn and asking to be picked up in the morning. Bunn and Megan had sexual intercourse. However, Megan apparently became uncomfortable with the situation. Unable to exit through Bunn’s locked bedroom door while he slept, Megan jumped through a window. Megan reported that she had been raped, stating that she had verbally expressed a lack of desire to have sex. Bunn told his attorney that he had no memory of the encounter due to intoxication. Trauma associated with the incident contributed to Megan’s deteriorating mental state, withdrawal from university, and ultimate suicide. Megan’s parents, Michael and Cynthia Rondini (plaintiffs), brought a wrongful-death action against Bunn. The action included claims of wrongful imprisonment and assault and battery in connection with alleged sexual assault. Bunn moved for summary judgment, arguing that there was no evidence of assault or battery because Megan consented to have sex with him.
