Facts

The United States International Trade Commission (ITC) investigated potential dumping of certain steel products being imported into the United States (defendant). The United States ITC determined that the domestic steel industry had suffered material injury due to increased imports. The investigation concluded that domestic shipments fell from 8,010 short tons valued at $67.4 million in 1984 to 6,681 short tons valued at $60.2 million in 1986. The average number of domestic workers fell from 407 to 234 in the same time period. Sandvik AB, AB Sandvik Steel, and Sandvik Steel Company (plaintiffs) filed a lawsuit in the United States Court of International Trade to challenge those findings.
